A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall pay 90,650,000 won to an applicant for compensation.

3.2

Punishment of the crime

1. Fraud;

A. On October 27, 2015, the Defendant committed the crime against the victim B, the Defendant made a false statement to the victim B, “The C Public Offering Project is in progress. D consortiums may have shares in sales agency business and business profit-making. When investing funds, the Defendant would guarantee principal and high-income.”

However, the defendant was unable to subscribe to a public contest project, such as the sale agency, and the victim did not have the intent or ability to guarantee the principal and high profit even if he remitted money.

The Defendant received 2,50,000 won from the victim’s account in the E Bank’s name on the same day, starting from June 4, 2018, the Defendant received from the victim totaling KRW 90,650,000 from the victim, from that time, to June 4, 2018.

B. On May 1, 2016, the Defendant committed the crime against the Victim G, with respect to the amendment of the Seongbuk-si vibration on May 1, 2016, “C public offering is underway. A consortium may have a stake in sales agency business and business profit-making. When investing funds, the Defendant would guarantee the principal and high profit-making of KRW 50,000,000 by investing KRW 100,000,000 by December 30, 2016.”

However, the defendant was unable to subscribe to a public contest project, such as the sale agency, and the victim did not have the intent or ability to guarantee the principal and high profit even if he remitted money.

The Defendant received KRW 100,000,000 from the victim to the I Account in the name of the Enterprise Bank in H, Inc. on the same day.

2. On September 27, 2016, the Defendant, for the purpose of uttering, signed a document forgery and uttering of a private document with the same content as written in the attached Form, stating that “A written agreement on the participation in the sale of ac public-private partnership project” is “a written agreement on the participation in the sale of ac public-private partnership project,” using a computer network program at the Sung-nam City Council Secretariat at the Sung-nam District Council.
