1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The plaintiff is a corporation established for the purpose of developing software, program, advice, and supply, and the defendant is an institution established and operated by the Korea Veterans Welfare Corporation for the protection of persons of distinguished services to the State.

B. The Defendant promoted the “business of building a groupweg advancement computer system” in which the groupwegth system, such as electronic settlement, mail, and Meger, used inside the system, has been deteriorated due to the deterioration of the content of training. During that process, the Defendant announced the public announcement of the “construction of a groupweg advancement computer system” through the National Integrated Electronic Procurement System of the Public Procurement Service for the said business.

C. On November 19, 2015, in a competitive tender through the public tender notice, a contract for the construction of groupwale equipment (hereinafter “instant contract”) was concluded with the Plaintiff, a successful bidder, on the following matters:

- Tender - The construction contract period for computerized equipment with the advancement of group wale: Limited competitive bidding/total contract amount: At the closing date of the receipt of the tender document for goods and the documents for reference to the specifications: November 13, 2015 (gold 10:00 on November 13, 2015 (gold 11:00 on November 13, 2015), the estimated amount of PC for tender enforcement officers by our agencies: 46,00,000 won (including surtax): The Korea Veterans Welfare and Healthcare Corporation (the location of Gangwon-do original State):

D. On the other hand, the Defendant failed to perform the scheduled process despite the Defendant’s continuous demand for the performance of the contract, such as the Plaintiff’s submission of the commencement plan including the introduction equipment and s/www manufacturer’s assurance of technical assistance, the entire process schedule, and the progress plan by process, etc. within seven days after the contract was concluded on the tender specifications, which are a part of the terms and conditions of the instant contract.
