1. A. Defendant A, B, and C shall be punished by imprisonment with prison labor for not more than four months;

(b) for a period of one year from the date this ruling became final and conclusive;

Punishment of the crime

Defendant A, on April 27, 2016, was not detained due to a violation of the Assembly and Demonstration Act at the Chuncheon District Court on April 27, 2016, and was not detained on June 21, 2016 due to a violation of the Act on Urban Parks, Greenbelts, etc. at the same court on June 21, 2016, and was prosecuted due to a non-detained violation of the Act on Residential Intrusion at the original branch of the Chuncheon District Court on June 29, 2016, and was detained on December 29, 2016, and was pending in trial on December 29, 2016, respectively. Defendant B was detained due to a non-detained violation of the Act on Residential Intrusion at the original branch of the Chuncheon District Court on June 29, 2016.

Defendant

A and Defendant B are the joint representatives of the P Committee, and Defendant C is the executive chairperson of the P Committee.

1. The organizer of an assembly or demonstration in violation of the Act on the Assembly and Demonstration by Defendant C shall not commit an act clearly deviating from the scope of the reported purpose, date, time, place, method, etc.

As the organizer of an assembly, the Defendant: (a) from August 4, 2016 to August 10, 2016, at the Seocho Police Station, from August 4, 2016 to the same year.

3. In the “two access roads to the R parking lot,” the assembly was reported to hold a “S opposing assembly.”

Nevertheless, at around 14:00 on August 4, 2016, the Defendant: (a) held a “S opposing assembly” in Q Gun’s wall delivery and shooting distance outside the wall of Q Gun; (b) held a “S opposing assembly” on the same day from around 15:20 to around Q Gun’s wall to the front of the reported assembly site after moving approximately 20 persons, including the Defendant, A, and B, from around 15:20 on the same day, to the front of Q Gun’s wall; and (c) displayed “S opposing”, etc. under the pretext of demanding an interview with the head of Q Gun during the presence of approximately 20 persons, including the Defendant, A, and B, etc.; and (d) on the front of the Gun office’s parking lot, the “S opposing head of Q Gun is removed as an economic public official and dissiped by hanging a large banner.”
