1. On January 15, 2020, C Co. and the defendant deposited as gold No. 204 in 2020 between the plaintiff and the defendant 51,038.
Reasons
1. Basic facts
A. The Plaintiff is a corporation with the objective of jointly raising and selling pigs, operating feed factories, producing and selling feed, etc., and the Defendant is a corporation with the objective of developing, manufacturing, and selling health food and health auxiliary food, and D is a person who operates a swine farm in F, 000-gun of the Gyeonggi-do (hereinafter “instant farm”).
B. On July 27, 2018, D and E: (a) the Defendant: (b) “D borrowed KRW 3 billion from the Defendant on July 25, 2018 at the maturity of 24% per annum; (b) D and E borrowed the borrowed amount at KRW 750,750 per annum; (c) D and E provide the Defendant with pigs of KRW 8,000, totaling 4,500, totaled of KRW 750, 2,750, 4,000, to the Defendant by means of possession revision (hereinafter “instant transfer security”); and (d) a notary public drafted a notarial deed of monetary loan for transfer security (hereinafter “notarial deed of this case”).
C. On July 15, 2019, D and the Plaintiff entered into a contract for the entrustment of the raising of pigs (hereinafter “instant consignment contract”) with D, and the Plaintiff entered into a farm with D’s total sum of 1,480 won from July 17, 2019 to August 20, 2019 under the instant consignment contract.
D had raised the said money separately from 5 to 10 farms it operates. D.
In October 2019, 4,962 of the pigs raised at the farm of this case were slaughtered and 397 heads were purchased.
E. On October 19, 2019, the Defendant received a claim amounting to KRW 350,034,850 on the purchase price claim, which was entrusted by the Ministry of Agriculture, Food and Rural Affairs with the purchase-price of African swine from the Ministry of Agriculture, Food and Rural Affairs, under the instant No. notarial deed, to KRW 350,034,850, which was entrusted with the purchase-price of African swine from the Ministry of Agriculture, Food and Rural Affairs, and the above order was issued.
