A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On August 20, 2014, the Defendant: (a) prepared a false complaint stating that “G was present as a witness of embezzlement cases, such as the Gwangju District Court 2012Kadan5108, Jul. 24, 2014; and (b) submitted a false complaint to the public prosecutor’s office of the Gwangju District public prosecutor’s office located in Dong-gu, Gwangju, Dong-gu, Seoul, stating to the effect that “G was provided with a secured loan, despite G received the Defendant’s leased vehicle without permission, the amount of KRW 50,000,000 in cash upon receipt of the Defendant’s secured loan.”

In addition, on September 22, 2014, the Defendant prepared a false complaint to the public service center of the relevant Gwangju District public prosecutor's office, stating that “The Defendant, on June 20, 2011, provided G with the Defendant’s leased vehicle to I without permission, provided the Defendant with the vehicle storage certificate and vehicle operation consent, the vehicle delivery certificate, the vehicle delivery certificate, the vehicle delivery certificate, the vehicle vehicle delivery certificate, the vehicle vehicle vehicle delivery certificate, the vehicle delivery certificate, the vehicle delivery certificate, the vehicle delivery certificate, the vehicle delivery certificate, the towing approval and each letter on the vehicle abandonment, presented them to the said I, and presented them to the said I, which would be punished.”

However, in fact, the Defendant instructed G to offer the above Benz vehicles to I with the consent of the Defendant, prepared related documents, and subsequently received a secured loan, there was no fact that G used a forged transfer agreement, etc. or used a perjury.

Accordingly, the defendant was arrested for the purpose of having G receive criminal punishment.
