A defendant shall be punished by imprisonment for a term of one year and four months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 08:00 on February 17, 2019, the Defendant, without obtaining a driver’s license, driven a vehicle with a 50-meter loaded vehicle from the parking lot C located in Busan Northern-gu B to the E zone in the same Gu.

2. Around 08:00 on February 17, 2019, the Defendant was demanded to comply with a drinking test on the ground that there is a reasonable ground to recognize that he/she driven a bread motor vehicle under the influence of alcohol, such as smelling and smelling on the face, from a police slope G belonging to the Busan Northern Police Station E Zone, while driving the said bread motor vehicle under the influence of drinking on the front of the E Zone.

Accordingly, the Defendant refused to comply with a request for a so-called alcohol test by a police officer without any justifiable reason, even though he was required to comply with a so-called alcohol test by inserting about 20 minutes from the above slope G into the above E zone, and thereby refusing to comply with a request for a so-called alcohol test by a police officer without any justifiable reason.

3. 피고인은 전항과 같은 일시, 장소에서 위와 같이 경사 G으로부터 음주측정기에 입김을 불어 넣을 것을 요구받자 “야이 십새끼야, H이가 그렇게 시키더냐”며 욕설을 하면서, 위 경사 G이 들고 있던 감지기를 손으로 쳐서 떨어뜨리고, 재차 위 경사 G이 음주측정을 요구하자 “야이 샙새끼야 좆만한 새끼야, 니 이름이 뭐야 한 대 처버리까”하면서 위 경사 G의 가슴 및 왼쪽 뺨을 1회 때리고, “니는 옷을 벗어야 정신 차리겠다. I하고 J이 다 안다. 니는 이제 좆됐다”하면서 오른쪽 발로 위 경사 G의 낭심 부위를 3회 걷어차는 등 폭행하였다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers in criminal investigations.
