A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On February 26, 2017, the Defendant: (a) requested the victim’s credit on the “Duds” operated by the victim C in Daegu-guned Group B around 20:10 on February 26, 2017; (b) and (c) caused the damage of the victim’s credit, and (d) caused the damage to the victim’s credit, one set of electricity and coffee set at the market price equivalent to KRW 70

2. 업무 방해 피고인은 2017. 3. 1. 21:00 경 대구 달성군 E에 있는 ‘F 노래 연습장 ’에 들어가 일행과 함께 노래를 부르던 중, 같은 날 22:30 경 업주 G의 부탁을 받고 카운터에서 잠시 노래 연습장을 보고 있던 피해자 H에게 다가가 “ 내가 I 주점에 노래 방비 5만 원을 맡겨 놨는데 돈 내놔 라 ”라고 말하면서 카운터에 있던 볼펜을 이용하여 대리석 재질의 카운터 위를 수차례 찍고, 카운터에 놓여 있던 컴퓨터와 재떨이를 던지려고 하고, 불이 켜져 있던 초를 노래 연습장 입구 벽 쪽으로 던져 타일을 일부 파손시키고, 카운터 근처에 있던 석유난로를 발로 걷어차는 등 소란을 피워 손님들을 노래 연습장으로 들어오지 못하게 하고 노래 연습장 안에 있던 손님들을 밖으로 나가게 하여, 약 30 분간 위력으로 피해자의 노래 연습장 운영 업무를 방해하였다.

On March 1, 2017, at around 23:00, the Defendant: (a) avoided the disturbance as above in “Fing practice place” as described in paragraph (2) of the said paragraph; (b) was asked by the victim J (W, 64 years old); (c) was able to demand the victim to take out the disturbance while taking out the disturbance; (d) the victim’s hand by having the victim take one hand, thereby causing the victim’s injury to salt and tension with the part of the fingers that require approximately two weeks of treatment.
