피고인은 2014. 5. 19. 01:00경부터 같은 날 02:40경까지 안양시 만안구 B에 있는 피해자 C(여, 39세)이 운영하는 'D‘ 호프집에서 피해자가 다른 손님과 이야기를 한다는 이유로 그 손님들에게 "씹할새끼"라고 욕설하는 등 시비를 걸고, 피해자에게 닭뼈를 집어 던지며 “씨발년아, 개 같은 년아, 남자손님 올 때마다 잤냐”라고 욕을 하는 등 소란을 피워 이에 겁을 먹은 손님들을 그곳에서 나가게 함으로써 위력으로 피해자의 주점 영업업무를 방해하였다.
