A defendant shall be punished by imprisonment with prison labor for up to six months.
Reasons
Punishment of the crime
[2018 Highest 1496] No person shall transfer or acquire any means of access used to make a transaction request in electronic financial transactions or to secure the authenticity and accuracy of users and the details of such transaction.
1. Around January 2017, the Defendant: (a) sold a corporate passbook, etc. by telephone from a person who was unaware of his/her name in the vicinity of the apartment complex located in the Seocho-gu Seoul Metropolitan Government, Seocho-gu, Seoul, the Defendant transferred the type of 4 means of access to the name-based one, 2.5 million won per one passbook; and (b) the personal name passbook, 50,000 won per one passbook, after receiving a proposal from a limited liability company (D); (c) theOTP, withdrawal card, authorized certificate, password connected to the bank account in the name of the limited liability company (D); (e) the Korea Post’s account in the name of the Defendant (Postal Services); (c) three copies of the physical card connected to the F account (G); and (iv) a paper, stating the name-based one.
2. Around June 2017, the Defendant: (a) consented to a proposal that he would give KRW 2.5 million per head of the Tong if he sells a corporate passbook, etc. by telephone from a person who was unaware of his name in the vicinity of the Gunk Station located in Samsung-dong, Gangnam-gu, Seoul; and (b) transferred an OTP, withdrawal card, authorized certificate, and password connected to a bank account under the name of J (K) and a L bank account (M) to a person who was unaware of his name.
[2019 Highest 214] In using and managing the means of access, no person may transfer the means of access unless otherwise specifically provided for in any other Act.
Nevertheless, around September 2017, the defendant accepted the proposal that "I will give 500,000 won per 50,000 won per ec.c. e. c. c. c. c. c. in the vicinity of the Sc. Sc. Sc. located in Samsung-dong, Gangnam-gu, Seoul, with the intention of "I will give c. c. c. c. c. c. c. c. c. c. c. c. c. c. c. c. c. c. c.
