Reasons
Punishment of the crime
1. On June 2013, Defendant A, along with Q and R, intended to operate a private sports climate site, and the Defendant created a program that can operate “S, T, U (V, etc.”, a gambling site. R directly operates the said site in Thailand, and Q intended to collect money deposited in the account managed by the said gambling site.
No person, other than an entrusted business entity, who is a national sports promotion corporation or a person who is not an entrusted business entity, shall provide property or property benefits (a similar act) to persons who win the result by issuing voting rights for sports promotion or things similar thereto, and no person shall open a place or space for gambling for profit.
Nevertheless, in collusion with the above Q and R, from June 2013 to November 30, 2016, the Defendant opened “S, T, and U”, which is an Internet private sports soil site, and opened a space where gambling is conducted for profit-making purposes at the same time by making many and unspecified people go through the above Internet gambling site go through a axis, camping district, and farming district, and by making them go through the above Internet gambling site and paying dividends in cases where the result is f4,279,286,195 won in total during the above period.
2. As described in paragraph 1, Defendant B and the Defendants: (a) committed a similar act in which Party A et al. provided property or property benefits without being entrusted by the Korea Sports Promotion Foundation for Seoul Olympic Games; (b) provided goods or property benefits to persons who correctly predicted the outcome by issuing sports promotion betting tickets or similar things; and (c) provided members recruited by the recruited members with 3% of the amount of gambling at the said gambling site on condition that they receive commission fees, in order to assist them in establishing a space for gambling for commercial purposes.
