Reasons
Punishment of the crime
1. Defendant A committed the crime against the Defendants, from May 14, 2012 to January 9, 2014, operated “F Gameland” on the second floor of Daegu Suwon-gu E, and Defendant B served as the head of the business of the said F Gameland from April 2013 to January 8, 2014, and Defendant C served as an employee in the said F Gameland from September 2013 to January 8, 2014.
Defendant
A, from around December 2, 2012 to January 9, 2014, set up 50 game machines for the ocean-going game which was not classified in the said F Gameland, and provided 5,000 points to unspecified customers for use, so that one plastic merchandise coupon may be discharged if they were to use the said game, and exchanged the said merchandise coupon to the customers who acquired the said merchandise coupon with 4,500 won after deducting 10% of the commission per each merchandise coupon. Defendant B, from April 2013 to January 8, 2014, had the head of the business division, such as inviting customers from the above F Gameland, and Defendant C confirmed whether the police was coming from the G real estate office in this F Gameland, provided information on customers to the game room, provided information on things necessary for the game room, and provided them with things necessary for the game room.
Accordingly, Defendant A, from around December 2012 to April 2013, in collusion with Defendant A, Defendant A, and Defendant B, from April 2013 to September 2013, Defendant A, Defendant B, and Defendant C, in collusion with each other, engage in speculative acts using speculative machines in the above F Gameland from September 2013 to January 8, 2014, respectively, and exchanged tangible and intangible results obtained through the use of game products.
2. Defendant B and Defendant C’s co-principal activities constitute 5,00 points for customers via the said game, by setting up 50 marine camping machines which were not classified in the said F Gameland from January 9, 2014 to March 21, 2014, and providing them to an unspecified number of customers.
