그럼에도 불구하고 피고인은 ① 2018. 6. 30.부터 2018. 11. 16.까지 광명시 D 소재 ‘E(주)’에서 스페인산 돼지 등심과 미국산 돼지 전지 960kg을 3,760,000원에, ② 2018. 10. 16.부터 2018. 11. 16.까지 서울 영등포구 F 소재 ‘G’에서 미국산 소 차돌박이 120kg을 1,500,000원에 각각 구입한 다음, 위 ‘C’ 식당에서 ① 2018. 6. 30.부터 2018. 11. 19.까지 스페인산 돼지 등심 938.2kg을 탕수육 메뉴로, 2018. 7. 4.부터 20018. 10. 30.까지 미국산 돼지 전지 20kg을 짬뽕과 짬뽕밥 메뉴로 각 조리하여 66,375,250원 상당에 판매하면서 매장 내 메뉴판과 배달 어플에 ‘국내산’으로 원산지를 거짓 표시하였고, ② 2018. 10. 16.부터 2018. 11. 19.까지 미국산 소 차돌박이 119.5kg을 차돌박이 짬뽕, 차돌박이 짬뽕밥 메뉴로 조리하여 10,157,500원 상당에 판매하면서 원산지를 매장 내 메뉴판에 ‘국내산, 호주산’으로 배달어플에 ‘국내산’으로 원산지를 거짓 표시하였다.
