1. The Defendant shall pay to the Plaintiff KRW 45,301,055 as well as 15% per annum from November 1, 2015 to the full payment.
Reasons
1. Indication of claim;
A. The Plaintiff and the Defendant’s relationship are the usual employees, and the Defendant was a person who operated D’s “C” in the location of “C,” and the Plaintiff frequently performed alcoholic beverages in a car page operated by the Defendant and entered into mutual friendship, and the Defendant lent money to the Defendant as follows.
B. The Plaintiff’s lending of money and credit card to the Defendant (1) around March 2014, the Defendant lent the Plaintiff’s credit card to the Defendant to the Plaintiff that “I will not open a credit card because I have good credit, but if I have lent the card, I will pay for each month the amount used.” The Plaintiff lent the credit card to the Defendant around March 2014.
(2) Around June 2014, the Defendant loaned the Plaintiff’s business funds to the Defendant, with the Defendant’s belief, lent KRW 30,000,000 to the Defendant, on the ground that the Plaintiff sold D at present, and the purchaser paid the purchase price for eight months, and thus, he/she would pay the money at that time. In so doing, the Plaintiff requested that the Defendant lend KRW 30,000,000 from the National Bank on the part of June 11, 2014.
(3) The Defendant’s default of credit card payments and loans extended by the Plaintiff on a monthly basis after lending the credit card from the Plaintiff to December 2, 2014, but did not repay the loan amount of KRW 30,000,000 and interest thereon, which was received from the Plaintiff, to the Plaintiff on August 2014. From January 2015, the Defendant still escaped without paying the credit card amount to the Plaintiff.
