1. The Defendant’s KRW 30,000,000 and the Plaintiff’s annual rate of KRW 5% from July 14, 2017 to November 2, 2017.

1. The description of the reasons for the request shall be as specified in the attached Form;

The amount of consolation money shall be determined as KRW 30 million in consideration of all the circumstances, such as the period of marriage between the plaintiff and C, the attitude and degree of fraudulent act between the defendant and C, the circumstances leading up to the plaintiff's awareness of the above fraudulent act, and the influence of the above fraudulent act on the marital life of the plaintiff and C.

Therefore, the defendant is obligated to pay to the plaintiff compensation for mental distress caused by the above tort amounting to 30 million won and damages for delay calculated by the rate of 5% per annum under the Civil Act from July 14, 2017 to November 2, 2017, the day following the delivery date of a copy of the complaint in this case, as sought by the plaintiff, and 15% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the day of complete payment.

Thus, the plaintiff's claim of this case can be accepted within the above scope of recognition, so it is decided as per Disposition by admitting part of it.
