A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2019 Highest 1516"

1. Around 10:27 December 16, 2018, the Defendant made a false statement to the victim G (V, 29 years of age) who reported and contacted the Defendant’s mobile phone sales comments posted on the Internet Ekbook “F” in the building C, Ulsan-gun, Ulsan-gun, U.S., the Defendant sent money to the victim G (V, 29 years of age) with three cellphones on the face of the transfer of money first.

However, in fact, the Defendant did not have the above mobile phone, and there was no intention or ability to send the above mobile phone even if he received money from the victim because he did not have any intention to receive the money by deceiving the buyers of goods.

Nevertheless, the Defendant: (a) by deceiving the victims as above; and (b) from December 16, 2018 to December 18, 2018, the Defendant received a total of KRW 1,400,000 from the victims to the Kakao Bank Account (I) account in the H’s name for the sales proceeds of three mobile phones; and (c) from that time, from that time, the Defendant knew the victims eight times in total as described in the attached Table of Crimes (1); and (d) received a total of KRW 8,40,000 from the victims, respectively, from that time to January 22, 2019.

Accordingly, the defendant was informed of the victims and received property.

2. On December 16, 2018, the Defendant violated the Resident Registration Act and the unlawful uttering of official document: (a) sold a three-phone phone to G using H’s mobile phone at the same place as indicated in paragraph (1) via the Kakakao Stockholm message; (b) as the Defendant was, sent his resident registration certificate issued by the head of Ulsan Metropolitan City, Ulsan Metropolitan City, and H’s driver’s license photograph, which is an official document issued by the head of Ulsan Provincial Police Agency, to G from that time to January 19, 2019; and (c) sent his resident registration certificate and driver’s license photograph under H three times in total to verify the identity of the Defendant, as described in the attached Form (2).

Accordingly, the Defendant’s resident registration certificate of another person as above.
