A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

피고인은 2013. 7. 11. 17:20경 의정부시 가능동 364에 있는 의정부지방검찰청 정문 앞 노상에서 친동생이 억울하게 옥살이를 하고 있다는 생각에 술을 마시고 그곳에 설치되어 있던 교통유도 표식인 일명 ‘러버콘’을 손으로 집어던지는 등 행패를 부리다가, 이를 제지하러 온 의정부지방검찰청 소속 청원경찰 피해자 C(39세)이 피고인에게 “왜 러버콘을 이렇게 해놨냐”라고 항의하자, 이에 화가나 “야이 씨발 새끼, 좆같은 새끼”라고 욕을 하며, 피해자의 멱살을 잡아 바닥에 넘어뜨리며 손바닥으로 머리를 2-3회 때리고, 마침 의정부지방검찰청 정문 초소를 지나가던 차량에 피해자의 머리를 잡아 3, 4회 가량 부딪치게 하여 피해자 C에게 약 2주간의 치료가 필요한 목뼈 염좌 등의 상해를 가하였다.
