1. The Plaintiff:
(a) Geumcheon-gu Seoul Metropolitan Government shall pay KRW 7,035,780 and its related expenses from December 19, 2006 to April 2, 2014.
Reasons
1. Facts of recognition;
A. B, while possessing a building of 158.6 square meters in Geumcheon-gu Seoul Metropolitan Government (hereinafter “the instant site”), newly constructed a building for multi-household 3 multi-household (6 households) (the total area of 297.57 square meters; hereinafter “the building before the instant conversion”) on the said site, and completed the registration of initial ownership as of December 29, 192 with respect to the said building.
B. D purchased the instant building site and the instant building from B around December 9, 2001, and completed the registration of ownership transfer with respect to the said building site and building as of January 28, 2002, and E purchased the said building site and building from the said D on October 7, 2003, and completed the registration of ownership transfer with respect to each of the said real estate as of October 27, 2003.
C. On November 13, 2003, E converted the instant building into an aggregate building (six households), and accordingly, the said building was registered as an aggregate building on November 14, 2003 on the aggregate building register (hereinafter referred to as “the aggregate building”) and the said building was registered in the aggregate building register as of November 19, 2003.
E, on November 18, 2003, sold the instant aggregate building to six persons, such as F, as indicated in the details of change of ownership, and completed the registration of ownership transfer with respect to each section of exclusive ownership subject to divided ownership to the above buyers, but only completed the registration of ownership transfer with respect to each section of exclusive ownership subject to divided ownership, but the remaining co-ownership shares were left as owned by themselves.
