Reasons
Punishment of the crime
The Defendant is a person who has entered into a mobile phone new contract with a mobile phone agent working as a victim C in Gangseo-gu Seoul Metropolitan Government.
1. On November 4, 2016, the Defendant arbitrarily entered the name “E”, “E”, “F”, “G”, “G”, “G”, “Seoul Gangseo-gu Gangseo-gu Seoul Gangseo-gu Seoul Gangseo-gu, “E”, “E”, “E”, “E”, and “E” in the column for the payment method of charges, and then arbitrarily inserted the name of the bank in the column for the payment method, “Korea’s name, account number, account number, “E”, “E”, “E”, and “E” in the name of E.
Accordingly, the Defendant forged a new contract for mobile phone service in the name of E, a private document on rights and obligations.
2. In order to open a new mobile phone at the date, time, and place of the foregoing paragraph (1), the Defendant submitted a forged mobile phone service contract to C with the cell phone store employees as if it was actually prepared.
3. The defrauded submitted a forged Defendant’s new service contract under the name of E to the victim C, who is an employee of the aforementioned mobile phone store at the time and place of the above paragraph 1, and presented E passport, and applied for a new opening of the 7 mobile phone mobile phone in the opon as he/she was E.
However, the defendant did not receive the consent from type E on the opening of a mobile phone, and even if he opens a mobile phone in the type E name, he did not have any intention or ability to pay the value of the device or the mobile phone fee.
Nevertheless, the Defendant: (a) by deceiving the victim C and providing the victim with 7 mobile phones from the victim, the Defendant acquired the pecuniary benefits equivalent to KRW 1,049,010 in total of KRW 99,00 and KRW 50,010 in mobile phone termination money; and (b) thereby, he/she acquired the pecuniary benefits equivalent to KRW 1,049,010.
