Reasons
1. The following facts are either in dispute between the parties or in accordance with Gap evidence Nos. 3, Eul evidence Nos. 1 and 2, Eul evidence Nos. 5-2, and Eul evidence Nos. 6-2, and the purport of the whole pleadings. A.
The council of occupants' representatives of Defendant C Apartment (hereinafter referred to as the "Defendant's representative council") is an organization organized to manage the apartment of this case on behalf of the occupants of C Apartment located in Seoul Special Metropolitan City, Nowon-gu (hereinafter referred to as the "instant apartment"), and Defendant B is the head of the management office of the instant apartment.
B. Around November 30, 2017, and December 30, 2017, the Plaintiff drafted each of the following labor contracts with E-the-counter dispute resolution companies:
(hereinafter referred to as “each of the instant employment contracts,” and the term of each of the instant employment contracts (hereinafter referred to as “instant employment contracts”). Article 1 (Period of Contract) contract is December 1, 2017 to February 28, 2018.
Article 2 (Work Place) Places of work shall be the C Apartment Management Office.
Article 5 (Work Hours and Work Hours) (1) The start and end hours (including the break hours) shall be 06:30 to 06:30 on the following day, and the break hours of one day shall be 8 hours a day (2 hours a week, 6 hours a night).
(2) Recess hours are hours of meal (12:00 to 13:00, 19:00 to 20:00) and night recess hours (23:30 to 05:30).
The term of contract under Article 1 (Contract Period) of the Labor Contract dated January 1, 2018 to November 30, 2018 shall be the C Apartment Management Office. Article 5 (Work Hours and Work Hours) (1), 1,574,00 won in total / 98,760 won in month/ month/ month 98,760 won/ month/ month 1,672,760 won/ month 1), and the term of contract under Article 1 (Contract Period) shall be between January 1, 2018 and November 30, 2018. The work place under Article 2 (Work Hours and Work Hours) shall be the C Apartment Management Office.
