Reasons
Punishment of the crime
[criminal power] On January 24, 2013, the Defendant issued a summary order of KRW 3 million for a crime of violating the Road Traffic Act at the Seoul Central District Court. On June 26, 2013, the Defendant issued a summary order of KRW 1 million for a crime of violating the Road Traffic Act (unlicensed Driving) at the Suwon District Court. On May 8, 2015, the Defendant issued a summary order of KRW 1 million for a crime of violating the Road Traffic Act. On May 8, 2015, the Incheon District Court: (a) on the Incheon Central District Court’s Branch, he/she was sentenced to imprisonment for eight months with prison labor; (b) on May 16, 2015; and (c) on May 14, 2015, the Defendant was sentenced to a suspended sentence of imprisonment with prison labor at the Suwon District Court; (d) on the forgery of a private document; (c) on the use of a private electronic document; (d) on the use of a private electronic document; and (d) on May 2, the use of a private electronic document.
【Criminal Facts】
On June 2014, the Defendant thought that he was using B’s driver’s license obtained in a bus that was operated to the front of the Suwon Station for traffic control.
1. On December 10, 2014, the Defendant, while under the influence of alcohol at 0.120% of blood alcohol without obtaining a driver’s license on December 23:35, 2014, driven the Ecoon-line line from the section of about 100 meters from the front of a public parking lot located in the Gwanak-gu Seoul Special Metropolitan City, to the front of “Dju shop” located in C, to the road of “Dju shop” located in C.
2. On December 10, 2014, the Defendant on the unlawful uttering of official document: (a) around 23:35, 2014, while driving on the “Dju shop” in Gwanak-gu in Seoul Special Metropolitan City, Ecoon on the front of the “Dju shop” in Gwanak-gu in Seoul Special Metropolitan City, the Defendant was subject to the demand for a driver’s license by regulating the Ecoon
The defendant presented B's driver's license under the name of the director of the Seoul National Police Agency, which is a prior official document, as if the defendant was the defendant.
Accordingly, the defendant is an official document.
