A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant handled the Meteptop clopule (one philopon; hereinafter “philopon”) and marijuana, which is a local mental medicine, as follows:

1. The point of purchase or medication of cophophones on October 2017;

A. On October 20, 2017, at around 22:00, the Defendant: (a) administered with F that became aware of through SNS in Jung-gu Seoul, Jung-gu, Seoul; (b) decided to collect 200,000 won in cash; (c) contacted with a seller of narcotics, etc., known through the Internet G site, and transferred KRW 40,000 to an influent account designated by him/her; and (d) purchased 0.5 g of cellphone from H’s entrance public telephone boxes at around 23:00 on the same day by means of searching for approximately 0.5 g of cellphone.

B. The Defendant, together with F, injected approximately 0.05g of philophones purchased from the telephones stated in the above paragraph “A” with F, in a single-use injection machine for approximately 0.05g, and administered them in a way of injecting them into their arms blood cells.

Accordingly, the defendant, in collusion with F, purchased philophones and administered them.

2. On December 28, 2017, the Defendant: (a) purchased a phiphone on December 28, 2017; (b) around 16:46, the Defendant purchased the phiphone from a seller of narcotics, etc. (J:K) in the name-free on the Internet website that he/she became aware of through the Internet G site; (c) deposited KRW 700,000 in the account designated by the seller (L, corporate bank: M); and (d) on the same day, around 18:00 on the same day, the Defendant purchased the 1 package of vinyl, which was 1gh from the lower part of the O site located in the same Gu, which was known to the location of the phiphone to the place of concealment; and (d) purchased it by means of purchasing approximately 1 g of vinyl, which was 1g of this phiphone.

3. Sale and administration of philophones on December 29, 2017.

A. On December 29, 2017, the Defendant came to know through SNS, such as 'E’ at the I’ neighboring sub-competence around 01:00, Dongdaemun-gu Seoul Metropolitan Government I.
