1. The Plaintiff:

Reasons
Basic Facts
The plaintiff is an autonomous management body that consists of the occupants in order to manage the 7-dong 331 units of the Seongdong-gu Seoul Metropolitan Government A Apartment (hereinafter referred to as the "the apartment of this case") in the previous city.
Defendant Il Young-young Co., Ltd. (hereinafter referred to as the “New-young”) is a project proprietor and a Si Corporation that newly built and sold the instant apartment, and the Defendant Korea Housing and Urban Guarantee Corporation (the name of Korea Housing and Urban Guarantee Corporation was changed to that of Korea Housing and Urban Guarantee Corporation pursuant to Article 4 of the Addenda to the Housing and Urban Fund Act; hereinafter referred to as the “Guarantee Corporation”) is a company that issued a warranty bond for the repair of defects of the instant apartment to Defendant Shin Young-young.
On April 12, 2010, the execution of the contract for the repair of defects and the pre-use inspection on the apartment of this case between the Defendant Guarantee Corporation and the Defendant Guarantee Corporation, the guarantee creditor as to the apartment of this case, and the Defendant Guarantee Corporation entered into a contract for the repair of defects with the content of the contract for the repair of defects as stated in [Attachment 1] to perform the repair of defects or to pay the cost for the repair of defects in the case where the Defendant Il Young-young, upon receiving the claim for the repair of defects that occurred within the defect warranty period after having undergone the pre-use inspection of the new apartment of this case, and fails to perform it without any justifiable reasons.
