1. The Plaintiff:
A. As to Defendant B Co., Ltd.: KRW 1,822,854,606 and KRW 300,000,000 among them, May 19, 2015.
Reasons
1. Basic facts
A. Status 1 of the parties concerned) The Plaintiff is Suwon-si A Apartment-gu, Suwon-si (hereinafter “instant apartment”).
(2) The Defendant B Co., Ltd. (hereinafter “Defendant B”) is a project proprietor and a contractor who constructed and sold the instant apartment, and the Defendant Korea Housing and Urban Guarantee Corporation (hereinafter “Korea Housing and Urban Guarantee Corporation”) changed the name as the Housing and Urban Guarantee Corporation on September 15, 2015, according to Article 4 of the Addenda to the Housing and Urban Fund Act; hereinafter “Defendant Guarantee Corporation”) to manage the 15 East 793 households. The Defendant B Co., Ltd. (hereinafter “Defendant B”) is a guarantor to issue a warranty bond against the defect repair of the instant apartment.
B. On October 10, 201, Defendant B entered into a contract for the warranty of defects and usage inspection; Defendant B entered into each contract for the warranty of defects (hereinafter “each contract for the warranty of defects”) with the guarantee creditor and each contract for the warranty of defects with the content that, if Defendant B fails to comply with the claim for the repair of defects that occurred within the warranty period after having undergone the inspection for the use of new apartment construction of this case by having the guarantee creditor as to the instant apartment as the prime market, Defendant B received the claim for the repair of defects within the warranty period after having undergone the inspection for the use of new apartment.
