Reasons
1. Facts recognized;
A. The Plaintiff is an educational foundation that operates the O University, and Defendant B is a person who served as the Secretary-General of the O University from July 2010 to January 2014.
The remaining Defendants except the Defendant B (including the co-defendants in the first instance trial; hereinafter the status of co-defendants in the first instance trial is not indicated separately) are the sellers of each land listed in the separate sheet (hereinafter referred to as “each land of this case”) (hereinafter referred to as “the seller of this case”).
B. On the first half of 2010, the Plaintiff agreed to purchase the land of the Gangwon-do Tri-gun Pri-do for the construction of a title trust agreement between the Plaintiff and Defendant B, and concluded a title trust agreement with Defendant B, stating that it is difficult to complete the registration of ownership transfer immediately due to restrictions on the acquisition of farmland, such as the issuance of a qualification certificate for acquisition of farmland under the Farmland Act, with respect to each of the instant land, and completing the registration of ownership transfer under the name of Defendant B.
C. On July 1, 2010, the sales contract was prepared between the seller 1 C, D, E, and G’s agent F and the buyer B as the seller ; the buyer ; the 50/5203 shares of each land listed in the separate sheet No. 1 through No. 27; the 550/5203 shares of each land listed in the separate sheet No. 28; the land listed in the separate sheet No. 29 through No. 31 where the ownership transfer registration was completed in D; the land listed in the separate sheet No. 32 through No. 47; the land listed in the separate sheet No. 32 through No. 47 where the ownership transfer registration was completed in F; the land listed in the separate sheet No. 4653/5203 shares of each land listed in the separate sheet No. 28; and the purchase price of each land listed in the separate sheet No. 52 through No. 56565, Nov. 1, 2010.
