1. The plaintiff's claim is dismissed.

2. The costs of the lawsuit, including the part resulting from the supplementary participation, are all assessed against the Plaintiff.

1. Details of the decision;

A. The Plaintiff is a school foundation operating the E University (hereinafter “instant University”); the Intervenor B was newly appointed as a full-time lecturer on March 1, 1999; the Intervenor B was appointed on April 1, 2003; and the associate professor on April 1, 201, who was appointed as an associate professor on April 1, 201; the term of appointment on April 1, 201 until March 31, 201; the Intervenor C was appointed as a full-time lecturer at the instant University on March 1, 1992 and was appointed as an associate professor on April 1, 201 through October 31, 201; and the period of appointment as an associate professor on April 1, 2011 through April 31, 2011 to be newly appointed on April 31, 201, and was appointed as an associate professor on March 1, 2013.”

B. On September 1, 2016, the Plaintiff amended Article 31 of the Regulations on the Personnel Management of Faculty Members of the University and Article 5-2 of the Regulations on the Appointment of Faculty Members by a resolution of the board of directors on September 1, 2016 as follows. Before the amendment of Article 31 (Requirements for and Restrictions on Re-Appointment) of the Regulations on the Personnel Management of Faculty Members, a person subject to fixed-term employment shall meet the requirements of average of the following results: (i) the achievements by the faculty evaluation regulations on the teaching profession shall meet the requirements of average of the following. A person subject to fixed-term employment may be re-contracted for the period of six years and six years (14 days or more) 360 points and 200 percent of 20% of the average number of teaching staff in the industrial sector (14 days or more) 360 points and 200% of the number of assistant professors for the last four years in April 4, 2016, regardless of the requirements of paragraph (1).
