[2013 Highest 2919] The Defendant, around 16:20 on February 25, 2013, displayed and possessed the above store for the purpose of selling bags for women who had a trademark identical or similar to the "LOUIS VUTRON" (registration No. 012539), which is a trademark registered with the Korean Intellectual Property Office (registration No. 012539), at the “D” clothes sales store operated by the Defendant in Seongbuk-gu C commercial building A-16 in Seongbuk-gu, Sungnam-si, by designating the bags and handbags, etc. as designated goods, and thereby infringing the trademark rights of the trademark right holder by displaying a total amount of KRW 53,190,000 (the market price of goods estimated) in the above store for the purpose of selling them.

【2014고단374】 피고인은 2013. 12. 1.경 위 ‘D’ 의류판매점에서, 상표권자인 ‘샤넬’이 가방, 핸드백 등을 지정상품으로 정하여 대한민국 특허청에 제0309448호로 등록한 상표와 동일 또는 유사한 상표를 부착한 가품인 여성용 가방을 보관하다가 그 무렵 이름을 알 수 없는 손님에게 400,000원을 받고 판매하는 등, 그 무렵부터 2014. 1. 21.경까지 별지 범죄일람표(판매상품) 기재와 같이 타인의 등록상표 또는 이와 유사한 상표가 표시된 가품들 합계 21,935,000원(실제 판매가격) 상당을 판매하고, 2014. 1. 22.경 위 ‘D’ 의류판매점에서 위 ‘샤넬’ 상표와 동일 또는 유사한 상표를 부착한 가품인 여성용 가방 15개를 판매할 목적으로 위 매장에 전시소지하는 등 범죄일람표(압수물) 기재와 같이 총 686,010,000원(정품 추정시가) 상당의 가품 533개를 판매할 목적으로 위 매장에 전시소지함으로써 상표권자들의 각 상표권을 침해하였다.
