Defendant

A A shall be punished by a fine of 2.5 million won, and Defendant B shall be punished by a fine of 1.5 million won.

The above fines are imposed by the Defendants.

Punishment of the crime

No person shall possess, for the purpose of transfer or delivery, any goods identical with or similar to the designated goods on which another person's registered trademark or a trademark similar thereto is marked, without legitimate authority for use.

1. 피고인 A 피고인은 2016. 07. 17. 13:10경 서울 동대문구 D에 있는 E시장 내에 피고인이 운영 중인 노점에서, 상표권자 ‘샤넬'(프랑스)이 대한민국 특허청에 상표등록(등록번호: 제0065799호)한 프랑스 유명상품 ‘샤넬' 상표와 유사한 상표를 부착한 선글라스 3개, 라이터 2개, 상표권자 ‘룩소티카 그룹 에스.피.에이.'(이탈리아)가 대한민국 특허청에 상표등록(등록번호: 제0046281호)한 이탈리아 유명상품 '레이밴' 상표와 유사한 상표를 부착한 선글라스 6개, 상표권자 ‘오클리 인코포레이티드'(미국)가 대한민국 특허청에 상표등록(등록번호: 제0197600호)한 미국 유명상품 '오클리' 상표와 유사한 상표를 부착한 스포츠 선글라스 1개를 판매할 목적으로 위 노점의 탁자위에 진열해 놓음으로써 위 상표권자들의 상표권을 침해하였다.

At around 13:10 on July 17, 2016, Defendant B: (a) at the street store operated by the Defendant in the above E market; (b) at the trademark right holder’s trademark registration (registration number: 012364); (c) two clocks attached a trademark similar to the Switzerland’s trademark on which the trademark right holder’s trademark registration (registration number: 0122364) is granted to the Korean Intellectual Property Office; (d) one clocks attached to the Korean Intellectual Property Office (registration number: 063260) the trademark right holder’s trademark registration (registration number: 01) with the trademark similar to the trademark of the Switzerland’s trademark of the Republic of Korea; and (e) one clocks attached to the Korean Intellectual Property Office with the trademark right holder’s trademark registration (registration number: 01370).
