1. The Plaintiff’s appeal against the Defendants and the Defendant’s appeal are all dismissed.
2. Costs of appeal.
Reasons
1. The grounds alleged by the court of first instance and the Minister of Health and Welfare in each of the appeals filed by the Plaintiff and the Defendant respectively are not different from the contents alleged by the Plaintiff and the Defendant, and even if the evidence submitted in the first instance and the trial are re-examineed along with the aforementioned allegations, the Plaintiff’s claim against the Defendant Minister of Health and Welfare for cancellation of the notification of the notification of the person subject to publication of the list of false health insurance claims to the Defendant Minister, and the judgment of the first instance that rejected the Plaintiff’s remaining claims
Therefore, the reasoning for this Court regarding this case is that the reasoning for the judgment of the court of first instance is the same as that for the judgment of the court of first instance, except for the following modifications, and thus, it shall be quoted in accordance with Article 8(2) of the Administrative Litigation Act and Article 420
[Revision] Part of the judgment of the first instance court 13 4 and 5 4 , "former National Health Insurance Act (amended by Act No. 15348, Jan. 16, 2018; hereinafter the same shall apply), 14 , 14 , 9 , 15 , 10 , and 10 , respectively, "former National Health Insurance Act (amended by Act No. 11787, May 22, 2013; hereinafter the same shall apply)", 17 , 3 , "former National Health Insurance Act (amended by Act No. 15348, Jan. 16, 2018; hereinafter the same shall apply), 17 , and 8 , respectively, "National Health Insurance Act (amended by Act No. 11787, May 17, 2013)".
Part 12, Part 20, and Part 21 of the judgment of the first instance are as follows: “former Enforcement Decree of the National Health Insurance Act (amended by Presidential Decree No. 25429, Jun. 30, 2014)” (amended by Presidential Decree No. 2902, Jun. 26, 2018).
