그럼에도 불구하고 피고인은 2014. 2. 12. 경부터 2015. 3. 23. 경까지 부산 수영구 C에 있는 피고인 운영의 D 게임 랜드에서 ‘ 하제’, ‘ 고 인돌’, ‘2080’, ‘ 월드 스토리’, ‘ 판타지 아’ 게임 기 130대를 설치하고 그 곳을 찾은 불특정 다수의 손님들 로 하여금 게임기에 현금을 투입하고 자동 실행장치인 속칭 ‘ 똑딱이 ’를 이용하여 실력이 아닌 운에 따라 자동으로 게임을 진행한 후, 우연의 결과에 따라 정해진 일정한 점수를 획득하면 점수에 따라 9,900점 당 9,900원 상당 변경된 공소장에는 “10,000 점 당 1만 원 상당 “으로 기재되어 있으나, 이 법원에서 적법하게 채택하여 조사한 증거에 의하면 이는 “9,900 점 당 9,900원 상당” 의 오기 임이 분명하고, 공소장변경 없이 이를 정정하더라도 피고인의 방어권 행사에 실질적인 장애가 초래된다고 보이지 않으므로 직권으로 위와 같이 정정한다.
