Defendant shall be punished by imprisonment for a term of one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Indecent acts by compulsion;

In the same manner as Paragraph 1, the victim committed indecent acts such as deceiving the victim's chest and forcing him to become the victim.

2. 강간미수 피고인은 2019. 4. 초순 일자불상 19:00~20:00경 사이에 전남 강진군 F에 있는 자신의 주거지에서 팥죽을 전달하러 방문한 피해자를 보고 강간하기로 마음먹고 피해자에게 “앉아보라”고 하면서 피해자를 그곳 거실에 있는 돌 소파에 앉힌 다음 피해자를 끌어안고 입을 맞추고 피해자의 브래지어 속으로 손을 넣어 피해자의 가슴을 만지면서 피해자에게 “안방에 가서 한번 만 하자”고 말하고, 이를 거절하며 현관문으로 나가는 피해자를 쫓아가 피해자를 붙잡은 후 팬티를 벗기고 피해자의 음부를 핥으면서 “한 번만 해주고 가라”고 말하는 등 피해자를 강간하려고 하였으나, 피해자가 ‘다음에 응해주겠다’고 말하면서 나가는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.
