1. The defendant shall be punished by imprisonment for three years;

2. The defendant shall be ordered to complete a program for treating sexual assault for 40 hours.

Punishment of the crime

1. The Defendant violated the Act on the Protection of Children and Juveniles against Sexual Abuse (Indecent Act by force) committed indecent act by force against children and juveniles on March 2018, by dividing the victim (the victim (the 15 years of age) into B dialogues for about three days at the hosting site around March 2018. On April 1, 2018, around 13:0-14:30 as of the first day of April 2018, the Defendant: (a) entered Drata in Busan-gu, Nam-gu, Busan-gu, with the victim first met with the victim; and (b) went back to the third floor so that he/she could have the victim's face taken by hand; (c) but the victim refused it; and (d) committed indecent act by force on the victim's chest; and (d) from around that time to June 2018, the Defendant committed indecent act by force against children and juveniles by force on three occasions, as shown in attached Table 1.

2. 아동ㆍ청소년의성보호에관한법률위반(유사성행위) 피고인은 2018. 7. 초순 일자불상 15:30~17:30경 부산 중구 E에 있는 ‘F모텔’ 호실 불상 객실에 피해자를 데리고 들어가 피해자의 입술에 강제로 입을 맞추고 저항하는 피해자를 밀치며 상의를 올린 다음 가슴을 손으로 만지고 입으로 핥고, 피해자로 하여금 피고인의 성기를 손으로 잡아 흔들게 하고, 저항하는 피해자를 누르며 바지와 속옷을 벗긴 다음 손으로 피해자의 성기를 만지고 손가락을 집어넣어 유사성행위를 한 것을 비롯하여 그 무렵부터 2018. 11. 4.경까지 별지 범죄일람표 2 기재와 같이 6회에 걸쳐 아동ㆍ청소년인 피해자의 성기에 손가락 등 신체의 일부를 넣는 행위를 하였다.

3. A defendant, on November 4, 2018, tried to take a photograph of the victim against the victim's will by carrying out a cell phone dynamic image phone dynamics of the defendant between the defendant and the toilet at a Moel protection room, as described in the above paragraph (2), around November 17:03, 2018, while the victim tried to take a face of sexual intercourse with the victim against the victim's will.
