A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. At around 22:00 on February 29, 2016, the Defendant ordered 21,500 won food at the “E” restaurant of the victim D’s operation in Nam-gu Incheon Metropolitan City, Incheon, ordering the victim to take food at KRW 21,500,00, and then demanded the victim to calculate the amount of food to the Defendant, the Defendant must pay the amount of food to the Defendant. As above, the Defendant got the victim to attack and let the victim frighten frightly claim the above food cost, thereby acquiring economic benefits equivalent to the same amount.
2. Interference with business;
A.
