1. Revocation of the first instance judgment.

2. The Defendants are 1,947/3,947/3,000 of 3,137 square meters in Kimpo-si, Kimpo-si, Kimpo-si to the Plaintiff.

Reasons

1. Facts of recognition;

A. On May 9, 1972, the land category was changed to a road, and registration conversion was made on July 8, 1993 with C road 3,947 square meters on July 8, 1993.

The details of the change in the lot number of this case, including this, are as shown in the attached Form.

(2) The Defendants completed the registration of ownership transfer for shares 1,947/3,947/9 on April 1, 1997 with respect to C-road 3,947 square meters on May 30, 1997.

(3) On October 12, 1999, C road 3,947 square meters was divided into three thousand square meters and nine hundred and forty-two square meters, namely, C road 3,005 square meters (hereinafter “instant land”).

The instant land was corrected with the area of 3,137 square meters on February 7, 2020.

(4) On December 29, 200, the Defendants received compensation for KRW 47,571,000 from Kimpo-si and transferred the ownership of KRW 942 square meters to the Plaintiff.

B. The history of the national highways G (1) on December 1, 1938, the Joseon General Department newly constructed a local highway connected to Seoul and reinforcement by the former Joseon Order, designating the route as N, and used for the general public traffic. On December 27, 1966, the Plaintiff designated the said road as the Class II national highway.

(2) At around 1970, the Plaintiff: (a) incorporated the construction department into a road site the size of 586 206,586 square meters, including the instant complex lot number land; and (b) carried out the National Road Expansion Corporation (hereinafter “Road Expansion Corporation”).

On November 1, 1970, the plaintiff allocated the budget to Gyeonggi-do to take charge of the land compensation affairs, and the Kimpo-gun assisted the land compensation affairs in Gyeonggi-do.

On August 31, 1971, the Plaintiff designated national highways among F as G major national highways.

Since G was expanded to the fourth line of the road from around 1997, G was used for the passage of the general public until now.
