1. The Defendant shall pay to the Plaintiff KRW 39,378,918 and the interest rate of KRW 20% per annum from November 30, 2017 to the day of full payment.

From July 12, 1979 to November 15, 2017, the Plaintiff was employed and worked for the Defendant who conducts the clothing manufacturing business. The Defendant’s payment of KRW 1,200,00 in September 2017, the Plaintiff’s wage of KRW 700,00 in October, and the amount of KRW 1,60,00 in November, 200 in retirement pay, KRW 45,878,918 in total, and KRW 49,378,918 in November, 207, and KRW 10,000 in January 2018 may be recognized by taking into account the following facts: there is no dispute between the parties; or the Defendant’s payment of KRW 10,00,00 in total,00 in the statement in subparagraph 1.

Therefore, the defendant is obligated to pay the wages and retirement allowances in arrears with the plaintiff (49,378,918 won-10,000 won) and damages for delay calculated at the rate of 20% per annum under Article 37 of the Labor Standards Act and Article 17 of the Enforcement Decree of the Labor Standards Act from November 30, 2017 to the date of full payment after 14 days from the date of retirement of the plaintiff. Thus, the defendant is obligated to accept the plaintiff's claim.
