1. The defendant shall be punished by imprisonment with prison labor for one and half years;

2.Provided, That the defendant is above 3 years from the date this judgment became final and conclusive.

Punishment of the crime

[2012 Highest 171] Forgery of Securities

A. On August 25, 2011, the Defendant stated “F 103-1002 G” in the back pages of the check number E, face value of KRW 45 million, which was issued by him/her, within the D car capacity set up on the roads located in the Daejeon New Coal, on August 26, 2011, and marked “F 103-1002 G” on the back side of the check number of KRW 45 million at the point of issue of the National Bank of Korea where payment was made, and marked in advance a G seal attached to his/her name.

Accordingly, for the purpose of exercising rights, the Defendant forged G name’s endorsement, which is a statement on the rights and obligations of the per share sheet.

B. On September 7, 2011, the Defendant stated that “F APT 103 Dong 1002 G” was written in the back of a promissory note amounting to KRW 50,000,000 on the date of payment due on December 7, 2011, which was issued by him/her at his/her own office located at H, and on the back of the back of the promissory note amounting to KRW 50,000,000 in face value, and affixed a seal of G with his/her name attached thereto.

Accordingly, the Defendant forged the endorsement in the name of G, which is a statement on the rights and obligations of promissory notes, which are securities for the purpose of exercising.

Exercising forged Securities

A. The Defendant’s above No. 1 A

On the same day, at the L Office operated by K in the Jung-gu Daejeon District Court of Daejeon, he requested K to discount a check, and issued a copy of the check number E with the above forged endorsement as if it was actually prepared.

B. The defendant 2-B

On the same day, at the above L Office operated by K, he requested K to discount a bill, and issued a bill of promissory note (bill No. 1) which forged the endorsement as if it was actually prepared, and exercised it.

Fraud

A. On August 25, 201, the Defendant issued the victim’s 1-A at the above L office operated by the Victim K.

The check shall be presented and the check shall be discounted.
