A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2018 Highest 3726] On June 4, 2018, at around 01:35, the Defendant opened and intruded the entrance of the victim D(44) located in the Seocho-gu Seoul Metropolitan Government C Building 13 at the E office, and then opened and intruded the entrance of the object that was not locked with the intention of theft, and then opened the entrance of the object on the office’s books, the Defendant was discovered to the staff of the private guard company dispatched after hearing the external intrusion warning.

Accordingly, the defendant invadedd a structure managed by the injured person at night, and attempted to steal the property, but did not commit the attempted crime.

1. Around May 10, 2018, the Defendant intruded into a structure and stolen building: (a) opened a entrance that was not corrected in the interior exit of the victim’s G operation on the third floor of the Seocho-gu Seoul Metropolitan Government F Building; and (b) entered the store. The Defendant intruded into the store on the same date and time, in the same place, 150,000 won in cash owned by the victim.

In other words, they stolen them.

Accordingly, the defendant intruded on the structure managed by others, and stolen another's property.

2. On May 17, 2018, the Defendant: around 04:34, the Defendant: (a) opened an entrance which was not corrected to the interior of the H, and entered the store; (b) and (c) intrudes into the store; (d) subsequently, KRW 90,000 in cash owned by the victim in the saving depository for accounting;

In other words, they stolen them.

Accordingly, the defendant invadedd a structure at night and stolen another's property.
