In light of the relevant legal principles and records, the lower judgment that found the Defendant guilty of the instant facts charged on the grounds stated in its reasoning did not err by misapprehending the fact beyond the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or by misapprehending the legal doctrine on the expression of intention not to punish the crime of non-violation of punishment against the contrary, as alleged in the grounds of appeal

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
