1. Facts of recognition;

A. The defendant is an incorporated association established for the purpose of promoting the welfare and protecting the rights and interests of the visually impaired, and the plaintiff is a member of the Gyeonggi-do Branch Association of the visually impaired Association (hereinafter “B Branch Association”) as an affiliated organization of the defendant.

B. On February 14, 2014, the Plaintiff: (a) obtained 60 votes from 118 votes (including invalid votes 2 votes) among the total voting number of 118 votes; (b) obtained 56 votes; (c) was elected to the branch president of B branch; and (d) the election commission of B branch was publicly announced on the same day.

C. On February 17, 2014, the Defendant approved the Plaintiff as the sub-chapter president. D.

However, on February 17, 2014, D, a member of the B branch, submitted a civil petition stating that “The election of this case violated a neutral duty by speech and behavior supported by E by the Plaintiff, and members supporting the Plaintiff’s voting procedure are invalid due to serious defects in the election procedure, such as speech and behavior supporting the Plaintiff within the voting slip on the voting day.” On February 18, 2014, D, a member of the B branch, submitted a civil petition stating that “The Plaintiff sent the Plaintiff to the Defendant on February 17, 2014, despite the filing of the objection on February 17, 2014, it is unfair to urge C, a member of the election commission, who was the next holder of the instant election, to take corrective measures, to the Plaintiff on March 14, 2014, who was urged C, a member of the B branch branch, to intervene in the election of the members, and provided the Plaintiff with his voting management regulations to the Plaintiff on March 14, 2014.”
