A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The defendant is a person engaged in driving a B-learning passenger car in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes.

On June 2, 2016, at around 23:10 on June 2, 2016, the Defendant driven the said car while under the influence of alcohol of 0.303%, and led the D convenience points in the West-gu Seoul located in Seoan-gu, Seoan-gu to bypass the road to the direction of the Women's Center in the direction of the Seongdong Apartment.

In such cases, a driver of a motor vehicle has a duty of care to prevent accidents in advance by driving the motor vehicle, such as making a person engaged in driving of the motor vehicle a normal driving difficult due to influence of drinking, and driving the motor vehicle in a safe manner such as making a good report on the traffic situation and accurately operating the steering gear.

Nevertheless, under the influence of alcohol, the Defendant neglected to operate the steering gear accurately, and received the victim E (the age of 29) who was laid down in a brushed and frighted by the bypassing negligence.

Ultimately, the Defendant driven the said car in a situation where normal driving is difficult due to the influence of drinking, and suffered injury such as the left-hand salt, etc., which requires medical treatment for about two weeks.

2. Around 23:10 on June 2, 2016, the Defendant driven the said paragraph (1) while under the influence of alcohol content of 0.303% at a section of 150 meters from the 150m to the road front of the D convenience store located in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seocheon-gu.
