피고인은 2018. 7. 31. 15:00경 위 C 영어학원 강의실에서, 피해자로부터 “선생님, 저 옷 샀어요. 예쁘죠 ”라는 말을 듣자 “어, 이쁘네”라고 말하며 갑자기 양손으로 피해자의 양쪽 가슴 부위를 잡고 모으듯이 만지고, 손으로 피해자의 가슴골 부위를 만지며 “이 정도면 큰 편 아니냐 ”고 말하고, 이에 피해자가 그 상황에서 벗어나기 위해 “쌤, 저 바지도 샀어요. 예쁘죠 ”라고 말하였음에도 재차 손을 피해자의 바지 속으로 넣어 허벅지 부위를 만지고, 계속해서 손으로16:27 피해자의 가슴, 허벅지 부위를 만지고, 이에 피해자가 자리에서 일어났음에도 재차 손으로 피해자의 엉덩이 부위를 치면서 “운동했네”라고 말하고, 피해자가 다시 앉자 “다리에 키스하고 싶다”고 말하며 재차 손으로 피해자의 허벅지 부위를 만졌다.
