The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for six months.

1. The sentence imposed by the court below (ten months of imprisonment) is too unreasonable.

2. The circumstances unfavorable to the defendant are as follows.

The crime of each injury of this case is highly likely to be subject to criticism as the so-called "compacting crime" committed against victims who do not have any awareness without any particular reason.

Although the defendant was punished three times by a fine for violent crime, two times by a fine due to drinking driving, and one time by a suspended sentence, it seems that the risk of recidivism is also reasonable.

However, there are the following favorable circumstances for the defendant.

In other words, the defendant confessions all of the crimes of this case and reflects his mistake.

At the investigation stage, the defendant paid a considerable amount of money to the victims and agreed with the victims, and the victims submitted a written application seeking the defendant's prior action to the court of the second instance.

The defendant's act of committing the crime of this case is deemed to have been committed while the defendant suffered difficulties due to conflicts and divorces arising from the appearance of the preceding wife, or a large amount of obligation borne by him. The parents of the defendant appear to have repaid the defendant's obligation, and the parents and mothers of the defendant and the women's relatives of the defendant make efforts to prevent recidivism.

The defendant was detained in this case while serving as a part of the construction company. Considering that the representative and the members of the above company and the relatives of the defendant want to have the defendant's wife, it seems that social ties are relatively clear.

Considering such circumstances and other circumstances as the Defendant’s age, character and conduct, intelligence and environment, relationship with the victim, motive, means and consequence of the crime, and circumstances after the crime, the sentence of the lower court is deemed to be too unreasonable.

Defendant’s assertion is with merit.
