1. The Defendant’s notary public against the Plaintiff was a deed of January 20, 2014, drawn up on January 20, 2014.
Reasons
1. The facts following the facts do not conflict between the parties, or each statement of evidence Nos. 1, 2, 1-2, 2-2, 2-2, 3-1, 3-2, 4-4, and 5-2 of evidence Nos. 5-1, 1, 2, and 1-2 of evidence Nos. 5-2, and 3-1, 2, 4-2, and 5 of evidence Nos. 1-2 (the Plaintiff’s name following the Plaintiff’s seal is based on the Plaintiff’s seal, and the authenticity of the entire document is presumed to have been established. The Plaintiff’s defense to the effect that each of the above documents was forged
In the case of the Plaintiff, the Sowing Development Co., Ltd. (hereinafter “Nonindicted Company”), and C (hereinafter, the Plaintiff, the Nonparty Co., Ltd, and the Nonparty Co., Ltd, together, entered into a contract with the Defendant on December 12, 2013, under which the Defendant would pay KRW 30,000 to the Defendant after one month, if the Defendant invested KRW 3,000,000,000,000 to the Defendant on the same day.
B. On December 17, 2013, the Plaintiff et al. entered into a contract with the Defendant to pay KRW 40 million to the Defendant after one month, if the Defendant invested KRW 20,000,000, and the Defendant wired KRW 20,000 to the Nonparty Company on the same day.
(The part of the interest agreement in each of the above contracts seems to be null and void in accordance with the Interest Limitation Act, but it does not appear to be directly related to this case). (C)
Plaintiff
On December 12, 2013, the Plaintiff, etc. jointly issued a promissory note (hereinafter “instant promissory note”) with an addressee and face value blank, each blank, and a promissory note at sight of the due date. On January 20, 2014, a notarial deed was commissioned to the effect that a compulsory execution on the said promissory note was accepted through the Defendant’s agent under the name of the Plaintiff, etc., and accordingly, a notary public drafted the instant notarial deed as a document No. 59 on January 20, 2014, in which the notary public was drafted on January 20, 2014.
The defendant shall make the above notarial deed.
