1. The Defendant: (a) KRW 146,597,260 for the Plaintiff and KRW 25% per annum from January 9, 2015 to February 7, 2018; and (b) February 8, 2018 for the Plaintiff.

In light of the above legal principle, the interest exceeding 24% is null and void (see Supreme Court Decision 2008Da37742, Oct. 23, 2008). Therefore, on January 8, 2015, the Plaintiff’s payment of KRW 390 million to the above auction case should be made according to the order of Article 479(1) of the Civil Act. The above KRW 390,000,000,000, which is the date of the agreement on the principal of the loan of this case as indicated below (Calculation Table), shall be appropriated as the interest and delay damages incurred from May 25, 201 until January 8, 2015, which is the date of the agreement on the principal of the loan of this case, and the remainder of KRW 139,00,000,000,000 paid to the principal and interest of the loan of this case shall be appropriated within the scope of the principal and interest of the loan of this case.
