A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is between D and C, and is a simple one, and between victim E and the one.

피고인은 D(기소유예 처분)과 함께 2011. 4. 7.경 이천시 F 소재 피고인이 운영하는 ‘G’에서 피고인은 피해자에게 “내가 G을 시작하면서 시댁에서 6,000만 원을 빌려 왔기 때문에 이 돈을 변제해야만 남편과 이혼하고 당신과 결혼할 수 있다. 당신이 6,000만 원을 빌려주면 시댁 돈을 변제하고 남편과 이혼한 다음 당신과 결혼하겠다.”라고 말하고, D은 “언니랑 결혼하면 내가 언니의 아이들을 키워 주겠다. 언니에게 돈을 빌려주기로 하였으면 빌려달라.”라고 말하였다.

그러나 사실 피고인은 당시 주식회사 하나은행에 3,900만 원, 제2금융권인 주식회사 H에 1,500만 원, 사채업자들에게 약 2,800만 원, 시어머니에게 6,000만 원 정도의 채무가 있었고, 특히 위 G 영업이 어려워 주식회사 H으로부터 빌린 돈의 이자를 내지 못해 담보로 제공한 자신의 아파트에 임의경매가 들어오는 등 채권자들의 채무독촉이 심했으며 피해자 이외 다른 남자들도 있었기 때문에 피해자로부터 돈을 빌리더라도 시댁에서 빌린 돈을 갚고 남편과 이혼한 다음 피해자와 결혼하기보다는 급한 생활비 및 주식회사 H의 채무를 변제할 생각이었기 때문에 피해자로부터 빌린 돈을 변제할 의사나 능력이 없었다.

Nevertheless, the Defendant conspired with D and received KRW 60 million in cash from the victim on the same day.
