The prosecution of this case is dismissed.

1. On July 8, 2020: (a) around 02:17, the Defendant: (b) expressed the desire of the Defendant to move out on the ground that the Defendant would cover “Cina” elevator before “Cina” elevator located on the fourth floor of Yeongdeungpo-gu Seoul Building B, Yeongdeungpo-gu, Seoul; (c) caused the Defendant’s chest and neck by hand during the dispute between the victim D (Nam, 53 years of age) and Si reserve, and assaulted the victim by cutting down the victim’s chest and neck on two occasions; and (d) by cutting down the victim’s neck with two hands.

2. Determination

(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;

(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.

(c) No penalty: A victim's expression of intention not to punish him or her, as stated in the agreement submitted on September 21, 2020.

(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
