1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff is a police officer appointed as a policeman on August 5, 1989 and served in Busan Regional Police Agency, Youngdo Police Station B and C Team from January 26, 2018 after promotion to the police officer on June 1, 2013.
B. On October 2, 2019, the Defendant, following the resolution of the Busan Yeongdeungpo Police Station General Disciplinary Committee, took disciplinary action against the Plaintiff for three months of suspension from office (hereinafter “instant disposition”) pursuant to Article 78(1)1, 2, and 3 of the State Public Officials Act against the following misconduct (hereinafter “instant misconduct”).
① On June 2018, the Plaintiff received a request from a related person (D) who is a senior distributor of the train that is being investigated as a violation of the Fishery Resources Management Act at the Busan Coast Guard Station at the entrance of the Busan Coast Guard Station, 46 Busan Coast Guard, for the following reasons: (a) the Plaintiff is under investigation at the sea level due to the occurrence of illegal circulation; (b) the case is the same; and (c) the case is growing.
around 21:00 on June 11, 2018, at the “Fju” located on the 9th floor of the Busan Jin-gu E building, Busan, with the above-mentioned request from the interested parties (D) and received entertainment equivalent to 1.2.50,00 won as a solicitation for a case of fishery resources management violations being investigated at the sea and around the sea.
② Around June 2018, the relevant person (D) received entertainment equivalent to KRW 1.5 million from the relevant person (D) on the basis of the ex-ante request from the Busan Jin-gu Police Station to the effect that “I would like to make this case well resolved,” and “I would like to know about only once within I would be distinguished,” and “I would like to receive entertainment equivalent to KRW 1.5 million from the relevant person (D) on the F State store around June 27, 2018, for the purpose of making recommendations for the investigation of narcotics and for the solicitation of investigation in the light of alcohol level.”
