Punishment of the crime

1. Defendant A is the representative director of Defendant B, who is responsible for the safety and health management of his employees and acts for Defendant B, who is the business owner.

In the places where workers might fall down, as the end or opening of the work plate and passage, the business owner shall install a strong structure with sufficient strength protection measures, such as safety railings, fences, vertical fall-off networks, or covers, etc.

Nevertheless, the above Defendant, who is an employee of Defendant B, had the victim D, who was employed by Defendant B, enter and work with pipelines for the transfer of sunset from the 14th to the 8th floor of the above construction site through the elevator hole in order to perform internal scoping snow (debris), but did not install safety distress in the elevator set, and caused the victim D to die away from the concrete floor of the first floor below the 26th floor of the above ground.

2. Defendant B Co., Ltd. is a business owner who was awarded a contract of KRW 88,00,000 of the construction cost from Awre Construction Co., Ltd. among the new construction works of the E neighborhood living facilities in Eunpyeong-gu Seoul, and performed the construction from June 20, 2013 to March 30, 2014.

In the places where workers might fall down, as the end or opening of the work plate and passage, the business owner shall install a strong structure with sufficient strength protection measures, such as safety railings, fences, vertical fall-off networks, or covers, etc.

Nevertheless, Defendant A, who committed an act on behalf of the Defendant, had the Defendant commit an act in the same manner as the description, date, time, and place as the description in paragraph 1.
