Defendant shall be punished by a fine of KRW 3,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

From April 25, 2011 to August 30, 2011, the Defendant, as a person in charge of the field management of piping installation works at the G G business site located in Chungcheong-gun F Co., Ltd., the victim D representative director E, was determined to have excessively claimed working days and daily labor costs of the relevant business site, while managing the site of piping installation works at the said business site.

1. On May 3, 2011, the Defendant: (a) around May 3, 201, at the office of the Co., Ltd. D located in Seo-gu Daejeon-gu Daejeon, Daejeon requested the victim to pay the victim labor cost for 21 days in proportion to the root year of field workers; and (b) the per capita labor cost for 1,30,000 won is 1,000 won.

However, on-site workers worked for 16 days, and labor costs per person were 120,000 won.

As above, the Defendant, by deceiving the victim, received additional KRW 770,000 from the victim as the daily labor expense on May 9, 201.

2. On June 10, 2011, the Defendant: (a) around June 10, 201, at the office D Co., Ltd., the victim requested the victim to pay the Defendant labor cost for 186.5 days in line with the root year of field workers; and (b) the per capita labor cost for 1.30,000 won.

However, on-site workers worked 155.5 days a year, and the labor cost per person was 120,000 won.

As above, the Defendant, by deceiving the victim as above, received additional KRW 5,295,00 from the victim for the purpose of five-month labor expenses around that time.

3. On July 21, 2011, the Defendant: (a) around July 21, 201, committed the crime committed on July 21, 201, at the victim’s office D Co., Ltd., the working day of field workers is 29 days a year; (b) one person’s labor cost is 1.30,000 won per person; and (c) requested

However, on-site workers worked for 187 days a year, and the labor cost per capita was 120,000 won.

As above, the Defendant, by deceiving the victim as above, received additional KRW 7,025,00 from the victim under the pretext of a daily labor expense for six months around that time.

4. The criminal defendant committed on August 17, 201.
