Reasons
Punishment of the crime
1. A thief: (a) around 15:30 on July 10, 2018, the Defendant: (b) committed a cosmetic located in the Seo-gu Daejeon, Seo-gu, Daejeon; (c) the victim D (V, 64 years old); and (d) took advantage of the gaps where surveillance was neglected, the Defendant stolen the E- Card, which was inside the victim’s grandchildren on his/her own.
2. Fraud or the Specialized Credit Finance Business Act;
A. On July 10, 2018, around 15:36, the Defendant purchased a horse tobacco of KRW 4,500 in the market value at H points operated by the victim G (n, 46 years of age) located in Seo-gu Daejeon, Seo-gu, Daejeon, and presented the aforementioned E card in the name of the said proprietor as if it were his own card.
Accordingly, the card was stolen by allowing the owner of the above business to prepare a credit card sales slip without knowledge of the fact that the card was stolen, thereby avoiding the payment of the purchase price.
B. At around 14:43 of the same day, the Defendant, within the Kart operated by the victim J (Nam, 45 years old) located in the same Gu I, purchased daily necessities worth KRW 83,400,000, including the market value of KRW 3,000, and acquired financial benefits by presenting the E card under the above D’s name.
C. At around 16:56 on the same day, the Defendant purchased Dor 65,020 won, such as Dor 5,020 won, such as Dor Dor 5,00, at the end of 22,500 won at the market price, and acquired property benefits by presenting the E card under the above Dor Dor Dor Dor Dor Dor.
At around 17:18 on the same day, the Defendant paid KRW 300,000 of the mobile phone unpaid at the market price of KRW 297,00 and his mobile phone unpaid at the same time within Q sales agency where the victim P (n, 19 years of age) located in the same GuO worked as an employee, and acquired property benefits by presenting the above D E card in the above manner.
E. At around 17:36 of the same day, the Defendant is within the same R cafeteria located in the same Gu.
