Reasons
Punishment of the crime
[2016 Highest 596] Defendant A conspiredd to apply for the registration of a business operator in the name of Defendant A using a forged real estate lease agreement in the name of H, the owner referred to in Article 612 of the above commercial building, which is the owner referred to in Article 612, as a person in charge of the management of the above commercial building.
1. On June 30, 2014, Defendant B forged a private document: “I (G commercial building 612) in the area column located under the title of a real estate lease agreement using a computer located at the management office of the first floor above the above commercial building on the first floor; “Won 1,00,000 won (Won 1,00,000 won)”; and “Won 1,000,000 won (Won 1,000 won) in the guarantee column” in the next column; “I (J) in the city of Changwon-gu, Seoul; and (B) in the resident registration number column of the lessor; and (c) the Defendants printed out the private document by entering “H” in the name of the lessor in the name of the lessor at that time.
H’s painting was stamped.
As a result, Defendant A and B forged a copy of the real estate lease agreement in the name of H, a private document related to rights and obligations without authority for the purpose of exercising their rights in collusion.
2. On July 6, 2014, Defendant A filed an application for business registration with L as the place of business of the above shopping mall No. 612, and submitted the forged real estate lease agreement to a public official in charge of the original tax office, who is aware of the forgery, when Defendant A filed an application for business registration under Defendant A’s name.
As a result, Defendant A and B conspired to exercise one chapter of the real estate lease agreement in the name of H, which is a forged private document.
